The Doctor is Out

Thanks for all the messages of support and encouragement. Many of you suggested that I call the physician who performed the Independent Medical Exam. However, I am not supposed to have any contact with this doctor unless it is under the direction of Worker’s Comp.

Furthermore, he was not supposed to tell me as much as he did. In fact, this statement is included in his report: “No treatment was given or suggested to the claimant.”

All I can do is discuss the situation with my attorney. I don’t expect to get anywhere with that, though. The law firm I’m dealing with has been nothing more than another source of disappointment and disillusionment to me.

I really do give up and admit defeat. I just don’t have it in me to put any more effort into doing battle with The Powers That Be.

    Rest and regroup and find another way to approach this whole thing. You cannot live in pain and since you cannot live in pain you must find someone who can ease that pain. Logical this morning, aren’t I? You know you have support in this whole mess both on screen and in the real world. Hang in there {hug}

    Oh yeah, I forgot you said that before about the no-contact thing with that Doc. Too bad, and how unfair that he would say that and then pretend it didn’t happen, but I imagine his hands are tied too. I wonder how he feels knowing people need help and won’t get it from him. Maybe by telling you what he did he was hoping you’d have info to take to another Doc so you really could get treated. I’m sorry that you have gotten to this point of feeling defeated.

    Damn! And just think of all the people making a living off of your problem — doctors, lawyers, Worker Comp bureaucrats — and meanwhile you are left in pain.

    Have you seen the articles all over the web today they say that even badly done acupunture helps people with back pain? That could be something to pursue.

    That’s how TPTB usually win. They wear you down when they already know you are so sick and in so much agony and pain in the first place that you barely have the strength to handle what they put you through in the first place then after they squeeze out the last morsel of life and hope you have, they send you the news that you couldn’t prove your claim. Unless this is a final denial, then I hope you are able recover from this devastating blow and press on because giving up is what they want you to do.

    I agree with the comment before mine and with Jim’s. I’ve seen this happen before, many many years ago, with a claim my mother had against the school district where she ended up losing the bulk of her pension. I hope there is still something you can do. xoxo

  9. I agree with all that has been said. I wish there could be something I could do — it is so hard to see friends in pain and be helpless to aid.

  10. I am shocked and so sorry. I hope you have an opportunity to speak to the Judge at the WC hearing tomorrow. You can tell him what you were told, what pain you have been in since you returned to work and ask what options you still have. First, if there is any hope of refiling, get a new attorney if he is not fighting for you. Second, call WC Board to find out if there is an Ombudsman group to help you. And if all else fails, if you have an impairment rating from the surgeons, find out what permanent partial impairment you will get, take the money and find a Social Security attorney and file for disability.     {{hugs}} I hate the way the system screws people over until they give up so they can get out of paying what they owe. I wish things would work out better for you. I imagine you’ve always exhausted all the appeals?? I wish I new more about WC, other than that they suck {at least here in ND}
